Stephanie DiGiuseppe argues at the SCC: R. v. Sullivan et al.
Stephanie DiGiuseppe argued R. v. Sullivan, et al. at the Supreme Court of Canada on October 12, 2021. Mr. Sullivan was convicted of aggravated assault and assault with a weapon, while Mr. Chan of manslaughter and aggravated assault. At the time of offence, both were under the influence of psychotic drugs. DiGiuseppe argues that s. 33.1 of the Criminal Code is unconstitutional and that intent-based charges cannot be applied to behaviours resulting from self-induced intoxication.
